By using this website, you warrant on behalf of yourself, your users, and other parties you represent that you will not:

This constitutes the grant of a licence, not a transfer of title. This licence shall automatically terminate if you violate any of these restrictions or the Terms of Service and may be terminated by ROYAL HIMALAYA at any time.

Visa and Passport Requirements

To participate in any travel services with ROYAL HIMALAYA, it is essential to carry a valid passport with an expiration date that extends at least six months beyond the duration of your planned trip. Visitors to Nepal are advised that tourist visas are available upon arrival at Kathmandu Airport. Responsibility for obtaining all necessary visas lies solely with the traveller, and ROYAL HIMALAYA shall not be liable if you are refused entry due to incorrect or insufficient visa documentation. Royal Himalaya may provide guidance on visa applications if requested, but the responsibility remains with the traveller.

Travel Insurance Requirement

All travellers are required to carry comprehensive travel insurance that includes coverage for accidents, injuries, illness, death, and medical expenses. This insurance must cover emergency repatriation, including helicopter evacuation where applicable, and personal liability. Coverage for trip cancellations, curtailment, and loss of luggage or personal items is strongly recommended. You must carry proof of this insurance and present it to ROYAL HIMALAYA staff or service providers upon request. Failure to present adequate proof of insurance may result in the suspension or cancellation of your trip without refund.

Registration and Payments/Account Management

To access and use ROYAL HIMALAYA’s services, you may be required to create an account on our website. When registering, you are required to provide accurate and up-to-date information, including your full name, contact details, and any other information necessary for booking and communication purposes. You agree to update this information promptly if any changes occur. It is your responsibility to maintain the confidentiality of your account credentials, including your password. You are fully liable for all activities and actions carried out under your account, whether authorised by you or not. If you suspect or become aware of unauthorised access to your account, you must notify ROYAL HIMALAY immediately. We disclaim any liability for losses or damages arising from your failure to secure your account details.

During the registration process or when making a payment, you may be required to provide financial information relevant to your chosen payment method. This could include your credit or debit card details or other necessary information to complete the payment. All payments processed through our website are handled by third-party payment processors. These third parties are responsible for the security and handling of your financial information, in accordance with their respective terms and privacy policies. ROYAL HIMALAYA does not store or have access to your financial details, and by using our services, you agree to comply with the terms set by these third-party payment providers. We reserve the right to cancel or restrict access to your account if we believe there has been a breach of these Terms of Service or suspicious activity.

Booking and Payment Terms

Bookings are confirmed upon receipt of a deposit payment amounting to 25% of the total trip cost, which is non-refundable. The remaining balance must be paid before the trip starts or upon arrival in Nepal. Travellers are required to complete a Booking Form, submit a copy of their passport, and provide full payment details. Prices are listed in USD, POUND STERLING, EURO and any conversions will follow the exchange rates set by Nepal’s Central Bank on the date of booking. It is your responsibility to verify booking details upon confirmation to avoid errors.

Cancellation and Refund Policy

Cancellations must be made in writing, with the following refund schedule:

  • 30+ days before departure: 80% refund of the total fee
  • 15-29 days before departure: 60% refund
  • 7-14 days before departure: 25% refund
  • Less than 7 days before departure: no refund

For itinerary modifications post-confirmation, a 20% change fee will apply if changes are made 20 or more days before departure. Changes made within 20 days will be treated as cancellations.

Liability and Risks

Participation in ROYAL HIMALAYA’s trekking, touring, and adventure activities involves certain inherent risks, especially in high-altitude and remote areas where unpredictable weather may impact travel plans. By participating, travellers acknowledge these risks and agree that ROYAL HIMALAYA disclaims liability for injury, health issues, emotional distress, or any costs arising from necessary evacuations. ROYAL HIMALAYA urges all travellers to obtain travel insurance covering medical emergencies, evacuation, and repatriation. ROYAL HIMALAYA shall not be held liable for any consequential loss suffered due to disruptions or cancellations caused by these factors.

Injuries and Evacuation

ROYAL HIMALAYA is not responsible for any injuries, health conditions, or other conditions sustained during your trip. Our travel packages do not include personal insurance, and we strongly recommend purchasing coverage for medical and evacuation needs. Clients are responsible for any costs associated with medical treatment or evacuation if necessary.

Missed or Unused Services

ROYAL HIMALAYA does not offer discounts or refunds for services missed or unused during your trip, whether due to illness, death of a family member, or other circumstances, voluntary or involuntary. This includes but is not limited to missed flights, late arrivals, or premature departures.

Flight Delays, Cancellations, and Changes

Flight disruptions may occur due to unpredictable weather or other uncontrollable factors in mountainous areas. ROYAL HIMALAYA is not liable for any additional costs arising from delayed or cancelled flights. We recommend booking flexible international flights, as we cannot assume responsibility for missed connections due to domestic flight delays. Alternative arrangements may be made at your own expense if necessary.

Medical and Health Requirements

All participants are responsible for ensuring they are in the physical and mental condition necessary to participate in high-altitude trekking and adventure activities. ROYAL HIMALAYA reserves the right to refuse service to individuals whose health or physical condition may compromise their safety or the safety of others. Please consult a physician prior to travel to assess your fitness and inform us of any medical conditions or disabilities that may affect your participation. If a participant fails to disclose a health condition that impacts travel, ROYAL HIMALAYA reserves the right to cancel participation without refund.

Participant Behaviour Policy

ROYAL HIMALAYA prioritises the safety and enjoyment of all clients. Any behaviour deemed unacceptable, such as causing distress to other travellers, damaging property, or engaging in illegal activities, may result in the immediate termination of your participation in the trip. In such cases, no refunds or compensation will be provided, and you will be liable for any costs arising from your actions.

Image Rights and Publicity

By participating in a ROYAL HIMALAYA trip, you grant ROYAL HIMALAYA and its representatives the unrestricted right to capture, use, and publish photographs and/or videos of you, taken during your trip for promotional purposes. These images and videos may be used in various media formats, including print, online, and social media, without further consent or compensation.

Privacy and Data Use

ROYAL HIMALAYA respects your privacy and is committed to protecting your personal information. Any personal data collected during the booking process or trip will be used solely for trip arrangements and client support purposes. Personal information will not be shared with unauthorised third parties. For more detailed information about our data handling practices, please refer to our Privacy Policy available on our website.

Complaints

If you encounter any issues during your trip, please inform to ROYAL HIMALAYA representative or tour leader promptly. Complaints should be raised during the trip to enable immediate resolution. Any complaints raised after the trip will be reviewed by ROYAL HIMALAYA’s customer support team, although immediate resolution may not be feasible. Dispute Resolution

In the event of any disputes arising from these Terms of Service or your use of ROYAL HIMALAYA services, both parties agree to first attempt to resolve the dispute informally. Updates to Terms and Conditions

ROYAL HIMALAYA reserves the right to modify these Terms and Conditions at any time without prior notice. Please review these terms periodically to stay informed about any changes.

Right to Terminate

ROYAL HIMALAYA may suspend or terminate your right to use our website and these Terms of Service immediately upon written notice if you breach these Terms of Service.

Severance

Any term of these Terms of Service which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity of the remainder of these Terms of Service is not affected.

Applicable Law and Jurisdiction

These Terms of Service are governed by the laws of Nepal, with exclusive jurisdiction resting with the courts in Kathmandu, Nepal, including the District Court, High Court, and Supreme Court. By agreeing to these terms, you waive any rights to pursue legal claims in jurisdictions outside of Nepal.
